1. GENERAL

This Agreement (“Agreement”) constitutes a legally binding contract between you (“User”) and kreditbuddha (“Company”, “we”, “us” or “our”) governing your access to and use of the financial and related services provided by kreditbuddha (collectively, the “Services”).

By registering for, accessing, or using the Services in any manner whatsoever, you acknowledge that you have read, understood, and agreed to be bound by all terms and conditions set forth in this Agreement, along with all policies, notices, and guidelines incorporated herein by reference. Your continued use of the Services shall be deemed to constitute your explicit acceptance of this Agreement. You are advised to download, save, or print a copy of this Agreement (including all incorporated policies) for your records and future reference.

This Agreement is an electronic record generated under the provisions of the Information Technology Act, 2000, and the rules made thereunder, as amended from time to time. It is created by a computer system and does not require any physical or digital signatures.

This document is published in compliance with Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, which mandates the publication of rules, regulations, privacy policy, and terms of use for access or usage of the Company’s website and mobile application. For the purposes of this Agreement, the Company’s website and mobile application, including all associated domains, sub-domains, and technology platforms, shall collectively be referred to as the “Website”, “App”, “Mobile App”, or “Platform”.

Please read this Agreement carefully in its entirety. If you do not agree with any of its terms, you must not register for, access, or use the Services in any manner.

2. ELIGIBILITY

Access to and use of the Website is permitted only to individuals who are competent to enter into legally binding contracts under the provisions of the Indian Contract Act, 1872. Persons who are deemed “incompetent to contract” under the said Act, including but not limited to minors and un-discharged insolvents, are not eligible to use the Website.

If you are a minor, i.e., under 18 years of age, you must not register as a User of the kreditbuddha Website, nor shall you access, use, or transact on the Website. Any use of the Website or any transaction undertaken by a minor must be carried out solely by the minor’s legal guardian or parent, acting on the minor’s behalf.

kreditbuddha reserves the absolute right to terminate your registration, suspend your access, or otherwise deny you the use of the Website, if it is brought to kreditbuddha’s attention, or if kreditbuddha independently determines, that you are under the age of 18 years or otherwise incompetent to contract under applicable law.

3. PRIVACY

Any personal information submitted in connection with your use of the Offerings or the Site is subject to Our Privacy Policy, located at www.kreditbuddha.com/privacy-policy

4. REGISTRATION

To access and use the kreditbuddha Services or certain features of the Website, you may be required to register and create an account, including selecting a username and password (“Account”). The information you provide during the registration process enables us to manage your Account and deliver personalised content and services. You agree to provide true, accurate, current, and complete information at the time of registration and to maintain and promptly update such information as necessary.

You are solely responsible for maintaining the confidentiality and security of your Account, including your username and password, and for all activities that occur under your Account, whether authorised or unauthorised. You expressly acknowledge and agree that kreditbuddha shall not be liable for any loss, damage, or liability arising from your failure to safeguard your Account credentials or to comply with the security obligations set forth in this Agreement.

If you provide any information that is untrue, inaccurate, outdated, or incomplete, or if kreditbuddha has reasonable grounds to believe that such information is untrue, inaccurate, outdated, incomplete, or otherwise inconsistent with these Terms of Use, kreditbuddha reserves the right to suspend, terminate, or restrict your Account and/or deny you access to the Website or the Services, either temporarily or permanently, without prior notice.

You agree to:

1. immediately notify kreditbuddha of any actual or suspected unauthorised use of your Account or any other breach of security; and
2. ensure that you properly log out of your Account at the end of each session.

kreditbuddha shall not be responsible or liable for any loss or damage incurred as a result of unauthorised access to your Account prior to your notification to us of such unauthorised use.

Your Account is personal to you. You shall not assign, transfer, or otherwise permit any other person to use your Account, nor may you access or use another person’s account without the express permission of the account holder.

5. COMMUNICATIONS

When you access or use the Website, or when you send emails, submissions, data, information, or any other communication to us, you acknowledge and agree that such communication is being made through electronic records. You hereby provide your express consent to receive communications from kreditbuddha in electronic form from time to time, as may be necessary or appropriate in connection with your use of the Services, your Account, or for any other contractual, transactional, or regulatory purpose.

We may communicate with you by way of email, SMS, in-App notifications, electronic alerts, or any other mode of communication—whether electronic or otherwise—as deemed appropriate by kreditbuddha. You agree that all agreements, notices, disclosures, statements, and other communications that we provide to you electronically shall satisfy any legal requirement that such communications be in writing.

6. TRANSACTION AND COMMUNICATION PLATFORM

1. The Website functions as a technology platform enabling Users to interact with each other and with third-party NBFC partners for availing short-term loan services.
2. kreditbuddha is not a party to, and does not control, any transaction between Users and NBFCs.
3. All commercial and contractual terms are offered, accepted, and concluded solely between the Customer and the NBFC.
4. kreditbuddha does not determine, influence, or advise on such terms and has no liability for the performance of any contract between the Customer and the NBFC.
5. kreditbuddha shall not be responsible for any non-performance, breach, or failure of obligations by Customers or NBFCs.
6. Through our Platform, Customers may apply for loans subject to eligibility criteria. You agree that kreditbuddha and/or the NBFC may collect, verify, authenticate, and process your data and documents for sanctioning the loan.
7. To access the Services, you must register and submit accurate Personal Information, which may include identity, contact, financial, KYC, device, and third-party platform data. You authorize kreditbuddha to fetch, use, and periodically update this information from such platforms.
8. All actions undertaken by kreditbuddha on your behalf are strictly based on your express consent. You authorize kreditbuddha to obtain your credit information from Credit Information Companies. Loan sanctioning and disbursement are at the sole discretion of the NBFC and subject to required documentation.
9. You agree to repay all outstanding amounts to the NBFC in accordance with the repayment schedule provided on the Platform.
10. kreditbuddha may track your location during the provision of Services and until all outstanding dues are repaid. Uninstalling or discontinuing the App does not release you from repayment obligations.
11. You are solely responsible for all activities under your User Account and for maintaining confidentiality of your credentials. kreditbuddha shall not be liable for misuse of your Account. We reserve the right to accept or reject registration at our discretion.
12. You are solely responsible for ensuring the compatibility, functionality, and connectivity of your electronic device for accessing the Platform.
13. User Data may be stored for your convenience. By accepting these Terms, you authorize kreditbuddha to fetch and use such data for authentication and updating your credentials.
14. kreditbuddha makes no warranties regarding the identity, creditworthiness, or legitimacy of any User. Users are advised to exercise independent judgment.
15. kreditbuddha does not hold any right, title, or interest in any loan transaction between Customers and NBFCs.
16. You agree to indemnify and hold harmless kreditbuddha, its officers, and representatives from any claims, losses, or liabilities arising from actions of Users or third parties.

7. INDEMNITY AND DISCLAIMER OF WARRANTY

1. Indemnity

   You agree to indemnify, defend, and hold harmless kreditbuddha, its owners, affiliates, subsidiaries, group companies, and their respective directors, officers, employees, and agents, from any claims, demands, actions, liabilities, penalties, or costs (including reasonable attorneys’ fees) arising out of:

   1. your breach of these Terms of Use, the Privacy Policy, or any other applicable policies;
   2. your violation of any applicable law, regulation, or third-party rights, including intellectual property rights.
2. Disclaimer of Warranty

   The Website, Platform, and all content, features, and services made available through it are provided on an “as is” and “as available” basis. kreditbuddha expressly disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or security, as well as warranties arising from course of dealing, usage, or trade practice.

3. No Warranties

   kreditbuddha makes no representation or warranty that:

   1. the content or information on the Website will be complete, current, accurate, or suitable for your circumstances;
   2. the Website or Services will be uninterrupted, timely, secure, or error-free;
   3. the results obtained from using the Website or Services will be accurate or reliable; or
   4. any products, services, or materials obtained through the Website will meet your expectations.

8. INTELLECTUAL PROPERTY RIGHTS

a. The Platform is owned, controlled, and operated by kreditbuddha. All materials on the Website or App—including without limitation text, images, graphics, logos, icons, audio clips, video clips, software, and other content—are the exclusive property of kreditbuddha or its licensors and are protected by applicable copyright, trademark, and other intellectual property laws.

b. All materials made available through the Platform are provided solely for your personal and non-commercial use. You shall not copy, reproduce, modify, republish, upload, post, transmit, distribute, or otherwise exploit any content, whether directly or indirectly, in any form or by any means. You shall also not assist or enable any other person to do so.

c. Any use of the Platform’s content for commercial purposes, or any modification, reproduction, or distribution of such content on any other website, digital platform, or networked environment, without the prior written consent of kreditbuddha, constitutes a violation of copyright, trademark, and other proprietary rights and is strictly prohibited. Any use of the materials from which you derive monetary or non-monetary benefit shall be deemed commercial use for the purposes of this clause.

9. INTELLECTUAL PROPERTY AND TRADEMARK INFRINGEMENT COMPLAINTS

kreditbuddha respects the intellectual property rights of all third parties. If you believe that your copyright, trademark, or other intellectual property rights have been infringed or violated in any manner through the Platform, you may submit a written complaint to us at support@kreditbuddha.com .

10. DESCRIPTION

kreditbuddha does not warrant or guarantee that any descriptions of products, services, features, or other content available on the Website are accurate, complete, reliable, current, or error-free. All such information is provided on an “as is” basis, and kreditbuddha assumes no liability for any inaccuracies, omissions, or errors in this regard.

11. LIMITATION OF LIABILITY

a. In no event shall kreditbuddha be liable for any special, incidental, indirect, exemplary, punitive, or consequential damages of any kind arising out of or in connection with these Terms of Use, the Website, or the Services, even if you have been advised of the possibility of such damages.

b. To the fullest extent permitted by applicable law, kreditbuddha, including its directors, officers, employees, agents, affiliates, and service providers, shall not be liable for:

1. any injury, death, loss, claim, act of God, accident, delay, or any direct or indirect damages (including loss of profits, loss of data, or loss of savings) resulting from or connected to:
   1. your use of or inability to use the Website or any component thereof;
   2. any content, information, or services made available through the Website; or
   3. the performance or non-performance of kreditbuddha or any third-party provider;
2. any damage to your equipment, devices, software, data, or other property, including any virus, malware, or technological harm resulting from your access to, or download of content from, the Website.

c. Third-Party Websites

The Website may contain links to third-party websites or resources. kreditbuddha does not control, endorse, or assume responsibility for any such external sites, their content, products, services, or availability. You acknowledge that kreditbuddha shall not be liable, directly or indirectly, for any loss or damage arising from your use of, or reliance on, any such third-party websites or resources.

12. DISCLAIMER

a. The User acknowledges and agrees that he/she is fully aware of the rules, regulations, and risks associated with the services offered through the Platform. Information on the Website may be updated or modified periodically without prior notice.

b. kreditbuddha may, at its sole discretion, make improvements, modifications, or changes to the Website or the Services at any time. kreditbuddha shall not be responsible or liable for any unauthorized access, misuse, or disclosure of User data resulting from the User’s negligence, including but not limited to sharing login credentials or granting access to third parties, whether intentionally or unintentionally.

c. kreditbuddha does not handle or process any funds directly. The User agrees not to raise any claim or dispute against kreditbuddha or its directors, officers, employees, or agents arising from any acts, omissions, or breaches of law committed by the User or any third-party provider, which are beyond the control of kreditbuddha.

d. kreditbuddha reserves the absolute right to amend, modify, or supplement these Terms at any time at its sole discretion. Any such amendments may be communicated by posting the updated Terms on the Website or by any other method deemed appropriate by kreditbuddha. The User is responsible for reviewing the Terms periodically, and continued use of the Website shall constitute acceptance of the revised Terms.

13. LINKS TO OTHER SITES

The Website may contain links to third-party websites or online resources that may collect personally identifiable information or other data from you. kreditbuddha does not control, endorse, or assume responsibility for the content, privacy practices, security, or policies of any such third-party websites. Your access to and use of these external sites is at your sole risk, and kreditbuddha shall not be liable for any loss, damage, or liability arising from your interaction with such third-party platforms.

14. APPLICABLE LAW AND JURISDICTION

These Terms of Use shall be governed by and interpreted and construed in accordance with the laws of India. The place of jurisdiction shall be exclusively in Gurugram.

15. INDIA ONLY

Unless expressly stated otherwise, all materials, products, and services made available through the Website or App are intended solely for use, access, and distribution within India. kreditbuddha makes no representation or warranty that the content or services on the Platform are appropriate, accessible, or available for use in any jurisdiction outside India.

Users who choose to access the Platform from locations outside India do so at their own initiative and are solely responsible for compliance with applicable local laws. kreditbuddha shall not be liable for any services, product availability, refunds, or legal compliance issues arising from access or use of the Platform outside the territory of India.

16. PLATFORM USE

You agree that your use of the Platform shall comply with all applicable laws and the following principles:

a. Prohibited Content

You shall not upload, host, publish, transmit, or share any content that:

• belongs to another person without authorization;
• is harmful, defamatory, obscene, pornographic, paedophilic, invasive of privacy, hateful, racially or ethnically objectionable, or unlawful;
• is misleading, offensive to the online community, or promotes violence, harassment, illegal activities, gambling, money laundering, or copyright infringement;
• infringes any intellectual property, privacy, publicity, or proprietary rights;
• contains viruses, malware, bots, worms, or harmful code;
• impersonates another person or misrepresents your identity;
• threatens the sovereignty, security, or public order of India;
• violates any applicable law, regulation, or court order.

b. Prohibited Activities

You shall not:

• access the Platform using automated tools such as robots, spiders, or scrapers;
• attempt to hack, probe, scan, or test the security of the Platform;
• attempt unauthorized access to any account, server, or network;
• interfere with the functioning of the Platform or any transaction;
• use the Platform for commercial activities without kreditbuddha’s prior written consent;
• post defamatory or harmful statements about kreditbuddha or its partners;
• impose an unreasonable load on the Platform’s infrastructure;
• collect or misuse personal information of other Users.

c. Compliance and Cooperation

You shall comply with the Information Technology Act, 2000 and all applicable laws. kreditbuddha may disclose your information to law-enforcement agencies if required by law or for investigating unlawful activities.

d. Intellectual Property and User Content

By submitting content, you grant kreditbuddha a non-exclusive, worldwide, royalty-free, perpetual, and sublicensable license to use such content in accordance with the Terms and Privacy Policy. You represent that you own all rights to the content you provide.

e. Monitoring and Removal

kreditbuddha may monitor, remove, or modify any content that violates these Terms or applicable law. However, you remain solely responsible for your content and actions on the Platform.

f. Third-Party Interactions

Your dealings with advertisers or third parties on the Platform are solely between you and such parties. kreditbuddha shall not be liable for any loss or dispute arising from such interactions.

g. NBFC Disclosure

kreditbuddha may partner with multiple NBFCs. Loan disbursement is carried out by the relevant NBFC, as stated in the sanction letter provided to the borrower.

h. User Safety

You acknowledge the possibility of exposure to unauthorized or offensive content posted by others. kreditbuddha is not responsible for misuse of any information you choose to disclose publicly on the Platform. You are advised to share data carefully.
